Acceptance of Terms of Use:
The following Terms of Use (Conditions) apply to anyone accessing and using the BT Forums website (Site), or any part of it. BT may modify these Conditions from time to time and accordingly you are advised to keep up to date with the changes by regularly reviewing the Terms. By using the Site you agree to be bound by these Terms.
Eligibility:
BT Forums is intended for businesses and is available for your personal, non-commercial use only.
Access, Account Security and Registration Data:
When you use BT Forums, you may set up a personal profile, contact other users, join a community, and ask or respond to questions.
It is your responsibility to ensure that you have an appropriate web browser or any other technical requirements in place in order to access and make use of the Site.
In using this Site, you agree to:
(a) provide us with and maintain accurate, current and complete information about you on registration to the Site;
(b) be fully responsible for all use of your account and for any actions that take place using your account.
Changes to the Site:
BT reserves the right at any time and from time to time to modify, edit, delete, suspend or discontinue, temporarily or permanently, the Site (or any part of it) and/or the information, content, videos, materials, products and/or services (or any part of them) available through the Site at any time.
Ownership of Content that we provide:
Except for your content that you legally post to the Site, all content on the Site is owned by us or licensed to us by third parties, including without limitation information, text, designs, graphics, pictures, video, applications, software, sound and other files, and their selection and arrangement (?Our Content").
You must not, without our prior written consent, copy, publish, download, de-compile or modify Our Content or use any of the content either in whole or in part, without our written permission.
If you are eligible to access the Site, we grant you a limited license to access and use the Site and Our Content and to download or print a copy of any portion of the Our Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright, trademarks, logos or other proprietary notices intact. We may revoke this licence at any time for any reason.
Content you post on the Site:
You are responsible for all content, including without limitation, information, text, pictures, photos, messages, notes, videos, and other files, that you upload or post on the Site, or communicate to other users through the Site. If you did not create content that you post to the Site, it is your responsibility to ensure that you have the necessary consents from the owner of such content. You are responsible at your own cost for creating backup copies and replacing any content that you upload or post on the Site or provide to us.
When you upload or post your content to the Site you automatically grant us at no additional charge an irrevocable, perpetual, non-exclusive, transferable, worldwide license (with the right to sublicense) to use, copy, publish, reformat, translate and distribute your content in whole or in part for any purpose, including third party websites, even if you have removed it from the Site.
You warrant that you have the necessary consents to grant us the licence set out in these Conditions, and agree to indemnify us against all claims and proceedings arising from infringement of any third person's intellectual property rights by your posting of content to the Site. This indemnity does not apply to claims or proceedings arising from our use of your content other than in accordance with these Conditions. We can withdraw your content at anytime without notice for any reason.
Trademarks:
The content of the Site is protected by copyright, trademark and other intellectual property rights as applicable and is provided solely for your own use. Republication or redistribution of any of the content available on the Site including by framing or similar means is prohibited.
User Conduct:
You agree not to use the Site to:
- Be in any way be unlawful, defamatory or in contravention of any licence, third party rights, or in contravention of any guidance that we may give or our Acceptable Use Policy. This is located at www.abuse-guidance.com and may be amended from time to time;
- harvest or collect email addresses or other contact information of other users from the Site by any means for the purposes of sending unsolicited emails or other unsolicited communications;
- solicit or sell or promote any services of any type on the website without our written consent, which shall be given at our sole discretion.
- solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
- use the Site in any manner that could damage, disable, overburden or affect the operation of the Site;
- use automated scripts to collect information from or otherwise interact with the Site;
- register yourself for more than one account, or register on behalf of another individual or group;
- use the Site to impersonate someone else or provide false or misleading information about yourself, or create a false identity;
- use or attempt to use another's account, service or system without our written authorisation,
BT takes the misuse described above very seriously, and you agree to take all reasonable steps to make sure that it does not happen.
If BT reasonably believes that it has happened, BT may take immediate action to remove your content or suspend or end your access to the Site without telling you first, even if you were not aware of the misuse.
You agree to indemnify BT against all legal fees, damages and other expenses that BT may reasonably incur as a result of your breach of the paragraphs above. BT may also remove content that BT reasonably believes is in breach of the above.
If you believe that any content displayed or made available on the Site includes any of the above offences, you may contact us through the Site.
Personal Data:
- In addition to our commitments under our Privacy Policy, BT may keep any personal data that you disclose for the purposes of general trend and market analysis. It is your responsibility to ensure that you have the necessary consents if you pass on a third party?s e mail address to BT.
- You acknowledge that we may hold any personal data that you provide in the USA
Liability:
BT will be liable if you are injured or die as a result of our negligence. We do not limit that liability by these Terms any other way.
We have no liability (whether in negligence or otherwise) for any loss not reasonably foreseeable by us nor any loss of opportunity, goodwill, reputation, business, revenue, profit, or savings you expected to make, wasted expenditure or data being lost or corrupted.
Any liability we have of any sort (including liability for negligence) is limited to ?100 for all events in any 12 month period.
The Site is provided by on an "as is" basis and when available. BT excludes all warranties or representations, whether express or implied, to the fullest extent permitted by law, concerning the availability and accuracy of the Site.
BT excludes all liability of any kind (including negligence) in respect of any third party product, services, content, or other material made available on, or which can be accessed using, the Site or the validity of the provider of such product, services, content or other materials.
This does not in any way affect your statutory rights.
Disclaimer of warranties and representations:
BT excludes all warranties or representations whether express or implied, including without limitation any warranties or representations for merchantability, suitability, fitness for a particular purpose, non-infringement of proprietary rights or the accuracy or completeness of third party products, services, content or any other material made available on, or which can be accessed using, the Site, to the fullest extent permitted by law, (excluding fraudulent representations made by BT).
BT recommends that independent advice is sought regarding the accuracy or completeness of the products, services and content referred to or made available on this Site.
Law:
These Terms of Use are governed by and will be interpreted in accordance with English Law and any disputes relating to these terms will be subject to the exclusive jurisdiction of the English courts.
If any jurisdiction does not allow the exclusion of certain warranties or exclusion or limitation of liability for consequential or incidental damages, liability is limited to the fullest extent permitted by law and the remaining terms shall survive in full force and effect.
Security:
You are responsible for the security and proper use of any user IDs, PIN numbers and passwords required for registration with the Site and must take all necessary steps to ensure that they are kept confidential, secure, used properly and not disclosed to unauthorised people.
You are also responsible for who may access your pages and the necessary measures to limit such access. We do not warrant or represent that any security measures that we provide to enable such access to authorised users are fault free and you acknowledge that unauthorised users may be able to obtain access to your content should they be able to penetrate or circumvent our security measures.
User Disputes:
You are solely responsible for your interactions with other BT Business support forum users. We reserve the right, but have no obligation, to monitor disputes between you and other users.
Employees or professional advisors or agents of BT:
The BT Business Support Form is available to both non employees and employees of BT, including its professional advisors or agents.
You may be asked to identify yourself if you are an employee, or professional advisor or agent to BT, to a BT Moderator if requested.
As a BT employee, professional advisor or agent, you acknowledge that any post content that you provide is your opinion only and you agree that you will not make any representations on our behalf without our written consent.
